Terms of Service

These Terms govern access to and use of PayTravel (https://paytravel.co), including the dashboard, trip pages, traveler applications, booking flows, traveler profile access, payment tools, and related services.

1. Accounts and organizations

You are responsible for your account, organization workspace, published trip content, invitations, pricing, traveler communications, team access, and compliance with laws that apply to your travel business.

You are responsible for keeping login credentials, team permissions, connected accounts, devices, and internal processes secure. Tell us promptly if you believe your account or workspace has been compromised.

2. Bookings and traveler data

Organizations control the trips, booking flows, application questions, traveler records, uploaded files, payment requests, and communications they create in PayTravel. You must have the right to collect and use the information sent into the service.

You are responsible for the accuracy, legality, retention, export, and backup of your organization data, traveler data, documents, uploaded files, and communications unless a separate written agreement says otherwise.

3. Payments, commissions, and trip responsibility

Payment features may be powered by Stripe. Organizations are responsible for their customers and travelers, trip terms, eligibility decisions, itinerary accuracy, cancellations, refunds, disputes, taxes, and payment compliance. PayTravel provides software and does not operate or sell the trips listed by organizations.

We are not responsible for travel services, transportation, accommodation, activities, injuries, illness, denied entry, visa or passport issues, insurance, overbooking, itinerary changes, organizer decisions, supplier failures, chargebacks, or disputes between an organization and its travelers.

PayTravel may charge platform fees, service fees, or commissions on payments processed through the service where agreed with your organization or shown in the product, checkout, invoice, or written communication.

4. Subscriptions, cancellations, and refunds

PayTravel may offer a 14-day free trial and paid plans such as Starter and Ultimate. Subscription terms, plan access, billing dates, and fees are shown in the product, checkout, invoice, or written agreement. You can stop using the service or cancel according to the applicable plan terms. Access or features may be limited after a trial ends, cancellation, non-payment, failed payment, payment reversal, dispute, or abuse. Except where required by law or expressly agreed in writing, fees already paid are non-refundable, including unused time on a billing period. Duplicate charges or clear billing errors should be reported to legal@paytravel.co.

5. Booking pages and traveler consent

If you publish booking pages, install scripts, collect traveler applications, or process payments through your own travel business, you are responsible for giving the notices and obtaining the permissions or consents required for your travelers, customers, and jurisdictions.

You are also responsible for any trip-specific terms, privacy notices, health or safety disclosures, cancellation policies, refund policies, consent records, age or eligibility checks, and regulatory obligations that apply to your travel business.

6. Fair use and acceptable use

We may apply reasonable fair-use limits, rate limits, storage limits, or abuse-prevention controls to protect the service and other users. Do not use PayTravel for unlawful content, spam, phishing, fraud, malware, unsafe travel offers, sanctions evasion, or activity that harms travelers, organizations, the platform, or payment processors.

7. Third-party services and integrations

The service may depend on third-party providers such as Stripe, Cloudflare, email providers, analytics tools, messaging tools, APIs, and other integrations. You are responsible for approving, configuring, maintaining, and complying with the terms of third-party accounts you connect or use with PayTravel.

We are not responsible for third-party outages, pricing changes, account suspensions, rejected payments, API changes, data loss, security incidents, or service limitations outside our direct control.

8. Data, security, and cyber incidents

We use reasonable professional care and appropriate technical and organizational measures for the service, taking into account the nature of the platform, the tools used, the state of the art, implementation costs, and the risks involved.

No digital system can be guaranteed to be fully secure, uninterrupted, error-free, or immune from vulnerabilities, cyberattacks, data breaches, unauthorized access, malware, service outages, third-party failures, or data loss.

You remain responsible for your business, traveler relationships, accounts, users, access permissions, internal devices, backups, data governance, legal compliance, third-party providers, payment processors, messaging tools, websites, scripts, APIs, and any systems or credentials outside our direct control.

To the fullest extent permitted by law, we are not responsible for security incidents, data loss, downtime, unauthorized access, fraud, or cyber events caused by third-party services, compromised or shared credentials, client instructions, client-side configuration, organizer content, legacy systems, unpaid or disabled external services, other vendors, user behavior, or vulnerabilities that were not reasonably detectable at the time.

If we become aware of a relevant security incident affecting the service or personal data processed on your behalf, we will notify you without undue delay and cooperate reasonably so the issue can be reviewed, contained, or remediated.

Where we process personal data on your behalf, your organization remains the controller unless agreed otherwise, and we act only on your documented instructions. If a data processing agreement is required, the parties will put one in place separately.

9. Availability and changes

We work to keep the service reliable, but we do not guarantee uninterrupted availability, response times, data sync timing, payment provider uptime, or delivery of emails, messages, notifications, or webhooks. Features may change as the product evolves.

10. Liability

To the fullest extent permitted by law, PayTravel is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, bookings, travelers, trips, payments, chargebacks, refunds, reputation, or goodwill.

To the fullest extent permitted by law, our total liability for any claim relating to the service is limited to the amounts paid to us by your organization for the service during the three months before the event giving rise to the claim.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules.
